I heard someone on a podcast, probably someone from Sex Matters, which seems really good at explaining legal and policy issues, explain how the equalities act works with respect to ‘gender reassignment’. The equalities act requires people with a given protected characteristic to be treated the same way as anyone without that characteristic; ie the comparator is a person who does not possess that characteristic. So in the case of ‘gender reassignment’ the comparator would be a person of the same sex that has not had a gender reassignment; TIMs have the right to the same treatment as not women but rather men who have not had a gender reassignment.
