Ethics

Allison Bailey says a thing, and guess who comes along to say “Nuh-uh.”

The trouble with that is, Robin Moira White is opposing counsel in Allison’s case against Stonewall. White should not be messing with Allison on social media.

It’s as if the normal rules just don’t apply.

“@Transgendertrd are recognised experts in this field. Do not forget that the High Court in Bell v Tavistock granted them permission to intervene…”

“And who ‘recognises’ TT as education experts? Themselves?”

The first tweet says TT were recognised as such by the High Court, so the question has already been answered.

“I trust the judgement of the experts, including discrimination lawyers who put together this guidance.”

“You didnt answer my question about the recognition of TT?”

Again, the question was answered before it was asked. What is it with this topic that turns TRAs into liars?

Maybe it’s that liars are drawn to the whole trans thing.

It’s all about denying the truth, after all.

I don’t know what the rules are in the U.K. In the U.S., it is disallowed for an attorney to contact a plaintiff who has their own counsel. IOW, if Moria White has something to say to Bailey, she should be talking to Bailey’s attorney, not Bailey herself.

Here. From A Fish Called Wanda. A lawyer (John Cleese) is talking to a pretty young woman (Jamie Lee Curtis).

    – I’m so sorry, I’ve forgotten your name.

    – Wanda.

    – Wanda! What a fool, what a fool. Well, Wanda, there are really three… Not Wanda Gershwitz?

    – Yes.

    – Oh, my God.

    – What?

    – You’re his alibi. I can’t talk to you.

    – Why not?

    – My dear lady, you are a defence witness. I must ask you to leave immediately.

    – What did I say?

    – It’s not ethical for me to talk to a witness.

    – Everybody does it in America.

    – Not in England. It’s forbidden.

But what do they know? They’re just a bunch of comedians.

    Moria White tweets

I have in trans cases from different perspectives, which requires grounding in what the law IS, not what folk would LIKE it to be.

This is either word salad or, at the most charitable, missing some words.

Either way, it shows a remarkable lack of care and clarity from someone who’s profession is analysis, argument and communication.

It just occurred to me that this is the inevitable result of ‘we’re on the right side of history’. The end – the belief that they will ultimately be absolved of wrongdoing – justifies the wrongdoing.
