    That was extraordinary inapt. Or inept. Or both.

    In Nix v. Hedden, the US Supreme Court unanimously ruled that, for the purposes of customs declarations, tomatoes are vegetables, not fruits. Although tomatoes are botanically fruit, for certain legal purposes they are vegetables.

    In EU law (Directive 2001/113/EC), carrots, rhubarb, sweet potatoes, pumpkins, and ginger can be defined as fruits for the purpose of jam classification.

    SCOTUS can do what they want to do, but tomatoes remain a fruit. For tariff purposes, they were called a vegetable, but at one time, whales were declared fish by the courts, and that doesn’t change the reality that they are a mammal. Which just goes to show that lawyers and judges are not scientists, even if they identify as such.

    iknklast, the capybara and the beaver were declared to be fish by the Catholic Church, so parishioners could eat them on Fridays during Lent. They swim a lot, you know. Creatures of the water rather than the land.

    Sure, it’s silly. But I thought the bizarre tomato cartoon was especially bad because, well, first of all, the tomato IS a fruit, and the law can’t change that reality, and second of all, the law did, for specific purposes, consider it as a vegetable.

    So perhaps it’s a very good comparison for the TIM after all. Except that, to maintain the parallel, the graffitist should be painting “Tomatoes are a fruit,” not the opposite, and perhaps the graffitist should herself be a vegetable. You know, a tomato exclusive radical vegetablist.

    There is some confusion amongst the layman public regarding the tomato, but that just means some people are right and some are wrong. There is no doubt in science as to what a tomato is – it’s a fruit. It is not a matter of identity. Sooo how was this supposed to be analogous to trans people?

    Let’s celebrate diversity! The best way to engage in this joyful celebration is to report to the police anyone who disagrees with you about food taxonomy! That sure gives me a sense of joy and togetherness and tolerance and community! Thank you, police, for fostering this happy atmosphere!

    And in the stupid video, the tomato cannot figure out whether to go into the vegetable room or the fruit room, so it perhaps considers itself neither, yet it was a hate crime for someone to declare it not a fruit. Ridiculous.

    Tomatoes can also be called vegetables in that “vegetable” is often used to mean any edible plantstuff. In others words, Crying Tomato is free to use either bathroom and this mess is even stupider than it seems.
